This privacy policy describes the personal data collected or generated (processed) when you interact with Nike through our websites, our digital experiences and mobile applications, our stores, events, or through one of our other products or services , all of which are part of the Healthy Roots Platform (“Platform”). It also explains how personal data is processed, shared and protected, what choices are available to the user regarding personal data and how to contact us.

WHICH SUBJECT is the data controller of personal data?

The company "Healthy Roots" responsible for the processing of personal data depends on the way the user interacts with the Nike Platform and on the user's location in the world. In this privacy policy the relevant Nike group company is referred to as “ Healthy Roots ”, “ our ”, “ we ”.

WHAT personal data is collected and WHEN?

Healthy Roots requires certain personal data in order to provide the products or services you request. For example, when you make purchases, when you contact our consumer services, when you request to receive communications, when you create an account, when you participate in our events or contests, or when you use our Platform. Additionally, when you request specific in-store services, Healthy Roots may ask you to log in in order to provide services that are associated with your account (e.g., size, fit, preferences).

This personal data includes:

  • contact data including name, email, telephone number, shipping address and

billing address;

  • login and account information, including username, password and unique user ID;

  • personal data including gender, hometown, date of birth and purchase history;

  • information on payment methods or credit card;

  • images, photos and videos;

  • data relating to physical characteristics, including weight, height and sizes (for example, shoe size or clothing size);

  • physical activity data provided by you or generated through our Platform (time, duration, distance, location, calorie count, step count); or

  • personal preferences including your wish list, as well as marketing and cookie preferences.

We also collect additional personal data in order to develop certain features within our Platform. For example, we ask for access to your phone's location data to record your running route, your contacts so you can interact with your friends, your calendar so you can plan a training plan, or your social media credentials to be able to directly publish content from our Platform on a social network . The aforementioned personal data includes:

  • motion data detected by the device's accelerometer;

  • photo, audio, contact, and calendar information;

  • data detected by the sensor, including heart rate data and location data (GPS); or

  • social media information , including credentials and any information from your public posts about Healthy Roots or communications with us.

When you interact with our Platform, some data is automatically collected from your device or browser. Further information about these practices is included in the “Cookies and Pixel Tags” section of this privacy policy below. The above data includes:

  • Device ID and type, call status, network access, memory information, and battery information;

  • Traffic data about your visit and interactions with our Platform, including the products you viewed, added to your cart, or searched for, and whether you are logged in to your Healthy Roots account;

  • Cookies, IP addresses, referrer headers , data that identifies your browser and version, web beacons, tags and interactions with our Platform.

MINORS

In compliance with local legislation, we do not allow registration on our Platform to those who have not reached the minimum age established by the law of their country of residence. Parental consent will be required for minors to participate in Healthy Roots experiences and events.

TOOLS for managing the personal data that are collected

When using our Platform, we will promptly notify or request consent for certain activities. For example, we will ask for your consent to use your location and send you push notifications. Consent may be obtained via the Platform or using the standard permissions available on your device.

In many cases, your browser or mobile device platform provides additional tools that let you control whether your device collects or shares certain categories of personal data. For example, your mobile device or browser may offer tools that allow you to manage the use of cookies or location sharing. We encourage you to familiarize yourself with all the tools available on various devices and use them.

WHY and HOW personal data is used

We use personal data in the following ways:

To provide the functionality of the Platform and the services that are requested

When using our Platform, we use your personal data to provide the requested product or service. For example, if you make a purchase on Healtyroots.com, or take part in an event or promotion, we use the information you provide to communicate with you about the purchase, event or promotion. If you contact our Consumer Services, we use certain information about you, such as delivery or payment information, or information about the product you purchased, to help you resolve a problem or respond to a problem. to a question.

If you use our Platform to track your workouts or physical characteristics, we will collect this personal data and store it for you to review on the Platform. Exercise data may include data that you enter about your activity or data collected by your device during your exercise, such as location data and motion data. We may use this training data to calculate additional information about your activity, such as distance run or calories burned, so that any information that is calculated can then be provided as part of the functionality of the Platform.

In many cases, to use particular features of our Platform you may need to provide Healthy Roots with additional data or additional consent to use certain data in a certain way. For example, to use the heart rate tracking features of our Platform, you may need to connect to a heart rate monitoring device. Similarly, to share content on social media , you may be asked to provide credentials to access the relevant account.

To communicate information about our products, services, events and for other promotional purposes

After obtaining your consent, we will send you marketing communications and news about Healthy Roots products, services, events and other promotions that may be of interest to you. This consent may be revoked at any time. 

Direct marketing

If you are an existing Healthy Roots customer (for example, if you have placed an order with us), we may use the contact information you provide at the time of purchase to send marketing communications about similar Healthy Roots products or services, where this is permitted by law applicable (unless you have opted out of receiving such communications). In other cases, consent will be requested to send marketing communications.

Customization

With the exception of Training Data (described below), we may use information you provide to us and information about other Healthy Roots products or services - such as your use of the Healthy Roots Platform, your visits to, or purchases you make in stores Healthy Roots, participation in Healthy Roots events and competitions - to personalize communications about products and services that may be of interest to you. In doing so, we may combine information you have provided to us with information we have generated in relation to your online activity, including internal analytics and insights. Where required by applicable law, we will ask for your consent to carry out these activities. 

If you log in to your Healthy Roots account using multiple devices, we may associate you with the different devices you use to browse our Platform. We may use information collected through these devices to personalize communications about our products and services.

To operate, improve and maintain our business, products and services

We use the personal data you provide to us to operate our business. For example, when you make a purchase, we use that information for accounting, auditing and other internal functions. We may use personal data about your use of our products and services to improve your user experience and to help us diagnose technical and service problems and administer our Platform.

To protect ours or others' rights, property, or safety

Additionally, we may use personal data in connection with your use of our Platform to prevent, detect, or investigate fraud, abuse, illegal use, violations of our Terms of Use, and to comply with court orders, government requests, or comply with to applicable legal provisions.

For general research and analysis purposes

We use data about visitors' use of our Platform and Services to understand customer behavior or preferences. For example, we may use information about how visitors to Healtyroots.com search for and find products to understand how to best organize and present product offerings in our storefronts.

To use (process) training data

As noted above, Healthy Roots collects data about your workouts or physical characteristics, collectively referred to as “Training Data” in order to provide services on our Platform. Healthy Roots products and devices also allow you to connect to third-party devices that collect additional workout information. Due to the personal nature of this data, we are committed to providing clear information about how your Training Data will be used. Because this data may be considered sensitive in some jurisdictions, we take appropriate measures to protect and use this data and, where required by applicable law or Healthy Roots's internal policies, we will request your consent to use your Training Data. 

For account linking

If you decide to link your Healthy Roots Account to a membership account with a Healthy Roots Partner (“Account Linking”), Healthy Roots will obtain your consent to link and use the personal data obtained from the Linking Account, including your purchases and returns. We use this personal data to create the Partner Orders page viewable in your Healthy Roots account and to give you access to select benefits, such as access to exclusive Healthy Roots products, rewards and experiences, when you shop with our Partners. Healthy Roots will also use personal data to personalize your experience on the Healthy Roots Platform and, if you have given your consent, to send you personalized marketing communications. 

Other purposes

We may also use personal data in other ways and we will provide specific notice and request your consent where necessary at the time we collect it.

Legal bases

We process personal data in the terms established by law depending on the type of interaction with our Platform.

  • When you purchase Healthy Roots products from our Platform, your personal data is necessary to allow us to fulfill the contract we have with you. For example, payment and contact details are required to proceed with the delivery of your order.

  • When you use our Apps, we use your consent for processing and for limited purposes to fulfill the contract we have with you (for example, for purchases from the App).

  • We also apply other legal bases, such as our legitimate business interests, to process data on the effectiveness of our marketing campaigns, products, services, events and other promotional initiatives; to operate, improve and maintain our business, products and services; to protect the rights, property and safety of us or others; and for general research and analysis purposes. When we process personal data for our legitimate interests, we take appropriate measures – which we are happy to explain upon request – to ensure that the interests we pursue are balanced with your interests, rights and freedoms.

  • We also process your personal data to comply with legal obligations or to protect your vital interests. 

SHARING of personal data

Sharing done by Healthy Roots

Healthy Roots may share each of the categories of personal information we collect with the following types of individuals for the business purposes described below: 

  • Companies belonging to the "Healthy Roots" group for the purposes and under the conditions described above.

  • Service providers who process personal data on behalf of Healthy Roots described in the “Why and how we use personal data” section such as, where applicable, to process credit card and payment data, shipping and delivery, hosting, to manage data, to send emails, for research and analysis, to manage product and brand promotions, and to administer certain services and features. When we use third-party service providers, we stipulate agreements that require them to adopt suitable technical and organizational measures for the protection of personal data.

  • Partners with Healthy Roots, for the purpose of connecting your Healthy Roots account (with your consent) and providing you with related services and experiences.

  • Partners who run Healthy Roots stores, to help them run in-store activities and events. For example, Healthy Roots may share a list of attendees with partners hosting an event.

  • Other third parties to the extent necessary to: (i) comply with a public authority request, a court order or to comply with applicable laws; (ii) prevent illegal uses of our Platform or violations of the terms and conditions of use of the Platform or our policies; (iii) defend against third party claims; and (iv) facilitate the prevention or investigation of fraud (e.g. counterfeiting).

  • Third-party targeted advertising providers who provide us with personalized advertising and personalization services. We use these services to combine aggregate information we have with personal data in their databases to create custom audiences and tailor advertising to your interests on the Internet, including social media , as permitted by law. applicable. You can opt-out of personalized advertising and custom audiences by using the relevant settings in our Platform.

  • Any other third party, where consent has been given.

We may also transfer personal information we hold about you in the event of a sale or transfer of all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

Your sharing

When you use certain social features on our Platform, you may create a public profile which may include information such as your name, profile picture and hometown. Additionally, you can share content with friends or the public, including information about Healthy Roots activity. We encourage you to use the tools we provide for managing Healthy Roots social sharing to control what information is made available through  Healthy Roots social features  .

PROTECTION and MANAGEMENT of personal data

Cryptography and security

We use various technical and organizational security measures, including encryption and authentication tools, to ensure the security of your personal data.

International transfers of personal data 

The personal data we collect (or process) in the context of the Platform will be stored in the Qatar and other countries. Some of the data recipients with whom Healthy Roots shares your personal data may be located in countries other than the country in which your personal data was originally collected. The laws of the above countries may not provide the same level of data protection as the country in which you initially provided your data. However, when we transfer personal data to recipients in other countries, including Qatar, we protect that personal data as described in this privacy policy and in accordance with applicable law.

We take steps to comply with legal requirements applicable to the transfer of personal data to recipients located in countries outside the EEA, the United Kingdom (UK) or Switzerland that do not provide an adequate level of data protection. We take various measures to ensure that personal data transferred to such countries is adequately protected under data protection provisions; this includes signing European Union Standard Contractual Clauses or verifying that the recipient has adopted Binding Corporate Rules. For data transferred within Healthy Roots, we use an intercompany data transfer agreement. 

Storage of personal data

We retain personal data for as long as necessary for the purposes set out in this privacy policy (unless otherwise required by law). Generally speaking, this means that we will retain your personal data for as long as you have a Healthy Roots account. Personal data relating to the purchase of products are stored for longer to fulfill legal obligations (for example those required by tax and sales legislation and for warranty purposes). 

Opt-out for direct marketing

If you have a Healthy Roots account, you can stop receiving marketing communications by changing your preferences in the “view and edit my profile” section of our Sites. You can also opt-out by changing your email subscriptions or SMS by clicking the unsubscribe link or following the opt-out instructions included in the message. You can also contact us using the contact details provided in the “Questions and Feedback” section below.

COOKIES and Pixel Tags

Healthy Roots collects information from your browser when you use our Platform, which may also include personal data. We use various methods, such as cookies and pixel tags, to collect this information, which may include: (i) IP address; (ii) unique cookie identifier, cookie information, and information about whether or not your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type and language, (v) operating system and system settings; (vi) country and time zone; (vii) previously visited websites; (viii) information about your interaction with our Platform, such as clicks, purchases and preferences indicated; and (ix) access times and referring URLs.

Third parties may also collect information from our Platform through cookies, third-party plug-ins and widgets. Third parties collect data directly from your web browser and the processing and handling of that data is subject to their respective privacy policies. 

We use cookies and pixel tags to track our customers' use of our Platform and to understand their preferences (such as country and language choices). This allows us to provide services to our customers and improve their online experience. Additionally, we use cookies and pixel tags to obtain aggregate data regarding Platform traffic and interaction on the Platform, to identify trends and obtain statistics so that we can always improve our Platform. There are essentially four categories of cookies used on our Platform:

  • Strictly Necessary (Always Enabled) : This choice enables the core functionality to enable your language, location, and cart. Additionally, it supports security, network management, and accessibility.

  • Personalized Experiences : Enables the use of behavioral data, through cookies and related technologies, to improve your experience and deliver relevant content across Nike platforms and communications.

  • Performance and Analytics : Enables the use of behavioral data to optimize performance, analyze your interactions with our sites and apps, and improve your Nike experiences.

  • Personalized ads : Allows sharing of behavioral data with advertising partners. This data is used to improve and monitor the personalized advertising experience on partner sites.

With reference to our Platform we use third-party analytics services. These third parties share reports with us about the use of our Platform, including to help us better understand the interests and demographic information of users of our Platform. These reports do not contain information that directly identifies you. However, they may be used by these third parties for our remarketing campaigns towards you if you have activated certain ad personalization services. Where required by applicable law, we will obtain your consent to carry out this activity.

You can always change your preferences by visiting “Cookie Settings” at the bottom of each page of our websites.

You may also see our ads on other websites, such as those of our partners, because we use third-party advertising services. Through these advertising services, we can show you ads that can be tailored to your individual interests. These advertising services may also track your online activities over time and across multiple websites and apps by collecting information through automated means. This data collection occurs both on our Platform and on third-party websites and apps that participate in these advertising services.

For a complete and up-to-date summary of all third parties accessing your web browser (whether through the Healthy Roots Platform or otherwise), we recommend that you install a purpose-built web browser plug-in. You can also set your computer to warn you each time a cookie is being sent, or you can choose to turn off all cookies. To do this, you need to access your browser settings on each browser and device you use. Each browser is slightly different, so you will need to consult the Help section of your browser to find out the correct way to modify your cookies. If you disable cookies, you may not have access to many features that make our Platform more efficient and some of our services may not function properly.

Similarly, you can select your advertising preferences on your mobile device at the device level. For example, to select your advertising preferences on iOS, visit Settings > Privacy > Advertising > Limit Ad Tracking. To adjust your advertising preferences on Android, visit Settings > Google > Ads > Opt out of interest-based ads.

USE of the Healthy Roots Platform with third-party products and services

Our Platform allows you to interact with a wide variety of other digital products and services. For example, our Platform may integrate with third-party activity tracking devices, social networks , music streaming services and other digital services.

If you choose to connect your Healthy Roots Account to a third-party device or account, your rights regarding the processing of personal data on third-party platforms will be governed by their respective privacy policies. For example, if you choose to share your Healthy Roots activity on third-party social media platforms , if you browse our website while you are authenticated on third-party platforms and have enabled certain ad personalization services, or if you ask us to link your Healthy Roots account to your membership accounts with Healthy Roots Partners, the information relating to these third-party platforms and Partners will govern the data residing there.

Our Platform may provide links or links to other (third party) websites and apps for your convenience or information. These sites and apps have their own privacy notices or policies, which we recommend you review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their contents or any use of the websites or apps or the privacy practices of such sites Web or app.
